Post-conviction DNA Testing in Colorado

State statute permits any prisoner currently serving his/her sentence to file for post-conviction DNA testing with the district court where the conviction occurred. In 2023, the law was amended to reduce the standard for granting a motion to access DNA testing, eliminate the requirement that a petitioner be currently incarcerated, allow courts to schedule a hearing for an immediate remedy if DNA testing results are probative, and to include defense attorneys in the forensic analysis process.
