New Trial for Tennessee Man Convicted of Rape

A Tennessee man convicted of rape in 2000 will receive a new trial based largely on conflicting reports of DNA evidence obtained from the victim’s body.
After DNA testing was conducted, a state official testified at Randall Mills’ trial that Mills could not be excluded as the perpetrator. But at a hearing last year, an independent expert testified to the contrary, according to the Marshall Country Tribune.
The independent expert from California, Gary C. Harmor said that the Tennessee Bureau of Investigation agent misreported the findings.
“So the male DNA you identified on the underwear could not be contributed by Randy Mills?” asked Craig M. Cooley, an attorney with the non-profit Innocence Project. “That’s right,” Harmor replied.
A hearing is being held today to discuss bond amount, appeals, and the possibility of a new sentencing hearing.
