Hearing Thursday Could Posthumously Clear Texas Man

The family of Timothy Cole will be in an Austin courtroom on Thursday hoping to see Cole’s name cleared of a 1985 rape. Cole won’t be with them, however, because he died in prison at age 38 in 1999.
Cole has been cleared by DNA testing, which proves another man committed the rape, for which Cole was sentenced to 25 years in prison. Attorneys at the Innocence Project of Texas are pursuing the state’s first posthumous exoneration in his case.
(Cole’s brother Cory) Session said for now all the family wants is to have Cole’s name cleared. He did not rule out pursuing civil damages for his brother’s wrongful conviction.
“There’s not one remedy that will bring Tim back,” Session said. “That is a pain I still do not know how my mother deals with.”
