Former Prosecutor Testifies about Possible Misconduct in Texas Wrongful Conviction

Two months ago, Michael Morton walked out of a Williamson County courtroom after his 1987 murder conviction was overturned because of new DNA evidence pointing to another man.

The Associated Press reported on efforts by Morton’s Innocence Project legal team to investigate whether former Williamson County District Attorney Ken Anderson intentionally withheld evidence indicative of Morton’s innocence. 

Now a state district judge, Anderson testified under oath for over eight hours in two sessions about Morton’s trial and said that although he couldn’t remember all the details, he believed prosecutors provided all necessary information to Morton’s legal team.

Defense lawyers asked the judge during the trial to review notes from the police investigation,      and Anderson said he would ensure that the judge was given all relevant material. The judge        later ruled that the notes would be of no help to the defense. 

But when case files were unsealed this summer, Morton’s attorneys discovered that the trial judge was only given a few pages — rather than extensive police case notes.
