Deception in Juvenile Interrogations in Nevada
State statute prohibits anyone authorized to conduct a custodial interrogation of a child from utilizing the following deceptive tactics during an interrogation: 1) knowingly making materially false statements about evidence, and 2) making express or implied promises of leniency or advantage. There is a presumption that any statement made by a child that was obtained in violation of this law is involuntary and inadmissible in any criminal or juvenile proceeding, which the State must overcome by a preponderance of the evidence. Effective: July 2024.
