The evidence against Green included separate identifications and serology showing that his blood type was consistent with the perpetrator’s. The first victim identified Green from a photo array and from an in-person lineup. The second victim identified Green in a show-up procedure. Both victims identified him in court.

Green’s attorneys obtained DNA testing prior to his sentencing. DNA testing on spermatozoa left on an item of the rape victim’s clothing excluded Green as the source. A motion for a new trial was granted in March 1990 and the indictment was subsequently dropped.
